On August 5, 2019, the Indian government revoked Articles 370 and 35A of its constitution, stripping the region of Jammu and Kashmir of its special autonomous status. This unilateral and controversial move is considered a direct assault on the rights, identity, and autonomy of the Kashmiri people. In Pakistan and among Kashmiris worldwide, this day is marked as Youm-e-Istehsal (Kashmir Siege Day) — a symbol of protest against the Indian occupation and its oppressive measures.
TheHistorical Context
The Kashmir conflict traces its roots back to the partition of British India in 1947. Under the partition plan, princely states were given the choice to join either India or Pakistan based on geographical proximity and the will of the people. Jammu and Kashmir, a Muslim-majority region, was expected to accede to Pakistan. However, the then Maharaja Hari Singh, a Hindu ruler, chose to align with India, leading to the first Indo-Pak war.
The United Nations intervened, and resolutions were passed, granting the right ofself-determination to the people of Kashmir. Despite these resolutions, the dispute remains unresolved after more than seven decades, with Kashmir bein gone of the most militarized zones in the world.
Article 370 and 35A — What They Meant
Article 370 granted Jammu and Kashmir a special autonomous status, allowing it to have its own constitution, flag, and autonomy over internal matters except defense, foreign affairs, finance, and communications.
Article 35 A provided special rights and privileges to the residents of Jammu and Kashmir, particularly safeguarding their rights to own property and employment in the region.
These provisions were seen by Kashmiris as a legal shield for their identity, land, and culture. The abrogation of these articles was perceived as an aggressive attempt to change the demographic and political status of the region.
August5, 2019 — The Day of Siege
On August 5, 2019, without consulting the Kashmiri leadership or seeking the consent of its people, the Indian government revoked the region’s specialstatus. The state was downgraded into two union territories — Jammu &Kashmir and Ladakh — placing them directly under New Delhi’s control. This move was accompanied by a complete lockdown of the region: Tens of thousands of additional troops were deployed. A curfew was imposed, confining millions to their homes. Internet and communication lines were cut off for months. Political leaders, activists, and even moderate voices were arrested. Basic human rights and freedoms were trampled. The region was virtually turned into an open-air prison, with the international community witnessing the systematic suppression of fundamental rights.
The Purpose of Youm-e-Istehsal
Pakistan designated August 5 as Youm-e-Istehsal (Kashmir Siege Day) to highlight the grave violations of human rights and international law perpetrated by India. The purpose of this day is:
· To express solidarity with the people of Kashmir.
· To raise global awareness about India’s illegal occupation and human rights abuses.
· To renew the commitment towards Kashmir’s right toself-determination.
· To protest against the Indian government’s demographic engineering tactics in the region.
TheAftermath — Life Under Siege
Since the abrogation of Article 370, life in Indian illegally occupied Kashmir has been marked by:
· Severe restrictions on freedom of movement and expression.
· Arbitrary detentions under draconian laws like the Public SafetyAct (PSA) and Unlawful Activities Prevention Act (UAPA).
· Curbs on media and press freedom.
· Increased military operations and civilian casualties.
· Economic decline and loss of livelihoods due to prolonged lockdowns.
Despite the oppression, the spirit of the Kashmiri people remains unbroken. They continue their peaceful struggle for freedom, enduring immense hardships with courage and resilience.
International Response
The global reaction to India’s move has been mixed. Human rights organizations like Amnesty International and Human Rights Watch condemned the lockdown and communication blackout, terming it a gross violation of basic rights. Countries like China, Turkey, Malaysia, and Pakistan strongly criticized India’s actions. However, many world powers, driven by strategic and economic interests, remained silent or issued luke warm statements. The United Nations voiced concerns but failed to take substantial action. The lack of decisive global response remains a source of disappointment for the oppressed Kashmiris.
Pakistan’sRole and Response
Pakistan has consistently advocated for the Kashmiri cause on diplomatic fronts:
The government regularly raises the Kashmir issue at the United Nations and other international forums. Special sessions and rallies are held across Pakistan every year on August 5 to observe Youm-e-Istehsal. Pakistani leaders reiterate their support for the Kashmiri people’s struggle for freedom. The Pakistani military and civil leadership emphasize that Pakistan will continue to extend moral, political, and diplomatic support to the Kashmiri people until they achieve their right to self-determination.
The Media and Public Campaigns
OnYoum-e-Istehsal, Pakistani media — both print and electronic — runs special campaigns highlighting Indian atrocities in Kashmir. Documentaries, special reports, interviews with Kashmiri leaders, and expert analyses are aired to create awareness among the masses. Social media platforms also become abattle ground for awareness campaigns, with hashtags like #KashmirSiegeDay and #StandWithKashmir trending globally. The youth, especially, play a vital role in using digital media to voice their solidarity with the Kashmiri cause.
TheUnyielding Spirit of Kashmir
Despite facing decades of violence, oppression, and betrayal by international powers, the Kashmiri people’s resolve for freedom remains steadfast. The people of Kashmir continue to resist with dignity and honor, refusing to surrender their rights and identity.
Conclusion
The abrogation of Article 370 marked a dark chapter in the history of Kashmir. However, it also intensified the resolve of the Kashmiri people and their supporters worldwide to continue the fight for justice. Youm-e-Istehsal servesas a yearly call to conscience — reminding the world that peace in South Asia is impossible without a fair resolution of the Kashmir conflict. It is a reaffirmation that the voice of the oppressed can never be silenced by force. The Kashmir issue is not merely a territorial dispute; it is a question of human dignity, freedom, and justice — and the world cannot afford to ignore it any longer.
